BenQ America Corp.’s Gift and Promo Code Redemption Policy for BenQ.com (the “Redemption Policy”)

This Redemption Policy governs the redemption of BenQ gift certificates and BenQ promo codes (whether physical or digital, collectively “Gift Certificates”) issued by BenQ America Corp. (“BenQ”) for programs, events, or promotions sponsored by BenQ at BenQ.com (“BenQ Events”). It also addresses third party issued gifts cards, i.e., Amazon that may be given as part of the BenQ Events.

Your submission of Gift Certificates for redemption indicates your acceptance and compliance with this Redemption Policy and with any terms and conditions of the program or event sponsored at BenQ.com under which you received the Gift Certificates (“Program Terms”), which are herein incorporated by reference as it pertains to the applicable Gift Certificate.

The issuance and validity of a Gift Certificate will be subject to the applicable Program Terms.
Gift Certificates are redeemable only by the customer that purchased the BenQ product(s) at BenQ.com under a BenQ Event.
Multiple Gift Certificates (two or more) may not be applied against the redemption of the same item, i.e., cannot use two promo coupons for the same projector, monitor, etc.
Gift cards from a third party, including without limitation Amazon, will be solely and exclusively governed by the terms and conditions of the applicable issuer of the gift cards as it appears on the gift cards without reference to this Redemption Policy. BenQ will not have any obligation, responsibility, or liability of any nature for the use, redemption, damage, loss, or claims arising or related to third-party gift cards.
Pictures of a gift, in terms of aesthetics, i.e., its color and appearance, are for reference only. The Gift Certificate recipient may not ask for a specific color, for a different gift, or exchange the gift for cash or credit. Changes will not be allowed once you select a gift.
Gift products are covered by the applicable manufacturer’s warranty terms and conditions; no other warranties are offered by BenQ.
Gift products obtained through the redemption of Gift Certificates issued by BenQ America Corp. will only be shipped to a physical street address in the 50 states.
Supply of gifts is limited and available only while stocks last. BenQ reserves the right to substitute any gift for one that is comparable in BenQ’s sole discretion.
In case the product that was purchased and for which a Gift Certificate was issued (and a gift product was obtained) is returned, BenQ reserves the right to reclaim the gift product that the customer received for the redemption of the Gift Certificate.
If a gift product for which a Gift Certificate was redeemed is not received within thirty (30) days of its submission for redemption, the customer must contact BenQ and file a claim. Claims filed outside the thirty (30) days period will not be honored and BenQ will not have any responsibility for providing a replacement or any other action.
Gift Certificates are not authorized for the purchase of products for resale.
Gift Certificates that are reproduced, copied, manipulated, or altered in any way from its origan form will be void.
Gift Certificates are void if restricted or prohibited by applicable law.
Gift Certificates will only be valid and honored for the term and purpose stated in the Gift Certificate and the applicable Program Terms. However, if there is a conflict between the Program Terms and this Redemption Policy, the latter will govern.
Gift Certificates cannot be sold, assigned, or transferred by their original recipient to anyone.
Gift Certificates will only be honored for persons.
Gift Certificates are not redeemable for cash, other Gift Certificates, or for anything else other than their Program Terms’ designated purpose. By way of example, without limitation, Gift Certificates cannot be used to pay taxes, shipping, etc.
If the customer returns the gift product obtained through the redemption of a Gift Certificate, BenQ will not reimburse, replace, or compensate the customer in any way for the Gift Certificate that was used.
BenQ will not be responsible for any Gift Certificate, or gift product for which a Gift Certificate was redeemed, that is lost, stolen, or damaged. No replacements or other compensation will be provided.
BenQ reserves the right to request evidence that the Gift Certificate was issued in compliance with Program Terms.
Any information provided by a customer redeeming a Gift Certificate will be covered by BenQ’s Privacy Policy.
YOU AGREE THAT FAILURE TO OBSERVE THESE TERMS AND CONDITIONS FOR PROPER REDEMPTION MAY, IN THE SOLE DISCRETION OF BENQ, VOID GIFT CERTIFICATE. THE EXERCISE OR WAIVER, IN WHOLE OR IN PART, OF ANY RIGHT, REMEDY, OR DUTY PROVIDED FOR IN THIS REDEMPTION POLICY WILL NOT CONSTITUTE THE WAIVER OF ANY PRIOR, CONCURRENT, OR SUBSEQUENT RIGHT, REMEDY, OR DUTY UNDER THIS REDEMPTION POLICY.
BENQ WILL NOT BE LIABLE FOR ANY AMOUNTS REPRESENTING LOSS OF PROFITS, LOSS OF BUSINESS, OR INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES (EVEN IF PREVIOUSLY APPRISED OF THE POSSIBILITY THEREOF) ARISING FROM OR RELATED TO ANY GIFT CERTIFICATE OR THE PERFORMANCE OR NONPERFORMANCE OF THIS REDEMPTION POLICY OR ANY ACTS OR OMISSIONS ASSOCIATED THEREWITH, WHETHER THE BASIS OF THE LIABILITY IS BREACH OF CONTRACT, TORT (INCLUDING WITHOUT LIMITATION NEGLIGENCE), STATUTES, OR ANY OTHER LEGAL THEORY. OTHER THAN AS EXPRESSLY STATED HEREIN, BENQ MAKES NO WARRANTY, WHETHER EXPRESS OR IMPLIED.
The provisions of this Redemption Policy are for the sole benefit of BenQ and their authorized resellers and their successors and permitted assigns and will not be construed as conferring any rights to any third party.
The terms of this Redemption Policy may be changed at any time and without notice by BenQ and in BenQ’s sole discretion. The current Redemption Policy in effect at any time will be posted here. No purchase order, invoice, email, retailer policy, or any other document not specified herein can be construed to modify any of the terms of this Redemption Policy.
Except as others stated herein, this Redemption Policy contains the entire agreement between BenQ and the customer with respect to the redemption of Gift Certificates.
This Redemption Policy will be governed by the laws of the State of California without reference to any conflict of law provisions. Any legal action related to a Gift Certificate must be brought within one (1) year from the issuance of the Gift Certificate, thereafter it will be barred. For the purpose of the assertion of a claim under this Redemption Policy, the recipient of the Gift Certificate herein agrees to submit to the jurisdiction of the courts located in Orange County, California, and waives any objections of forum non-convenience and lack of personal jurisdiction. Each party shall be responsible for its own attorneys’ fees and costs.
